Dumpster Rental Agreement

The customer, job site, dumpster size, rental dates, price and the transaction-specific pricing for each rental are shown in the accepted quote and are part of this Agreement.
1. Rental Terms
All Bin Direct Rentals dumpster rentals include a standard seven (7) day rental period unless otherwise agreed in writing. Customer agrees to pay all rental charges required by the accepted Bin Direct Rentals quote before delivery unless otherwise agreed in writing. Dumpster size, included disposal allowance, base rental price, additional weight pricing, and other transaction-specific pricing shown in the accepted quote are incorporated into this Agreement.
2. Disposal Fees and Additional Weight
Customer is responsible for disposal weight and other disposal charges exceeding any allowance included in the accepted quote. Additional standard disposal weight will be billed at the rate stated in the accepted quote or other written pricing for that rental. Because Bin Direct Rentals may arrange service through third-party providers and disposal facilities, disposal and overweight rates may vary by market, provider, material, and facility. Provider- or facility-assessed charges may be passed through to Customer as permitted by this Agreement and applicable law.
3. Heavy Materials
Dirt, rock, concrete, masonry, asphalt, and other unusually dense materials require prior written approval. Heavy-material pricing and weight limits are governed by the accepted quote or other written authorization. Loads exceeding approved weight or safe hauling limits may be refused, partially unloaded, or subject to additional provider, disposal, or handling charges.
4. Payment and Additional Charges
Customer authorizes Bin Direct Rentals to invoice and collect charges properly incurred under this Agreement, including additional disposal weight, approved heavy-material charges, extended rental, overfill, blocked-access or return-trip charges, damage, and other agreed or provider-assessed charges. Any late-payment charge, collection cost, or attorney-fee provision applies only to the extent stated on an invoice or other written terms and permitted by applicable law.
5. Prohibited Materials
No hazardous waste, chemicals, asbestos, batteries, tires, electronics, flammable materials, appliances, or unlawful materials may be placed in the dumpster unless Bin Direct Rentals gives prior written approval for a specific material. Customer is responsible for all costs, penalties, handling charges, remediation, or other losses caused by prohibited materials.
6. Site and Placement Responsibility
Customer selects and approves the placement location and assumes responsibility for site suitability, including pavement, driveways, landscaping, overhead clearance, underground utilities, septic systems, irrigation, and other property conditions. Customer is responsible for damage resulting from placement, use, service, or removal except to the extent caused by the negligence or willful misconduct of the servicing provider.
7. Access / Return Trip Fee
Customer must provide safe and unrestricted access for delivery, exchange, service, and removal. Customer must keep vehicles, gates, equipment, snow, debris, and other obstructions clear of the service path. If a scheduled delivery, pickup, exchange, or service cannot be completed because of blocked access, unsafe conditions, an unserviceable load, customer-requested changes, or another condition attributable to Customer, a return-trip fee starting at $110 may apply. Additional charges assessed by the servicing provider may also apply.
8. Right of Removal
Bin Direct Rentals or the servicing provider may remove or refuse to service the dumpster when Customer materially breaches this Agreement, fails to pay amounts due, places prohibited materials in the dumpster, creates an unsafe condition, or otherwise prevents lawful service.
9. Indemnification
To the extent permitted by law, Customer agrees to defend, indemnify, and hold harmless Bin Direct Rentals and the servicing provider from third-party claims, damages, fines, penalties, and reasonable costs arising from Customer's use, loading, placement instructions, prohibited materials, site conditions, or breach of this Agreement, except to the extent caused by the negligence or willful misconduct of the party seeking indemnification.
10. Governing Law
This Agreement is governed by the laws of the State of Washington, without regard to conflict-of-law rules, unless another state's law is required for a rental performed outside Washington.
11. Dispute Resolution
The parties agree to first attempt in good faith to resolve any dispute informally. Any mandatory arbitration requirement or venue provision must be stated in the accepted quote, an addendum, or other written terms provided to Customer and applies only to the extent enforceable under applicable law.
12. Extended Rental Fees
The standard rental period is seven (7) days. If Customer keeps the dumpster beyond the initial seven-day rental period, the standard Bin Direct extension rate is $125 per day for the first three (3) additional days, unless different pricing is stated in the accepted quote. If the dumpster remains beyond those three additional days, the rental converts to an additional seven (7) day rental period at the applicable weekly rental rate. Extension pricing may vary where a servicing provider requires different written terms, and any such pricing will be disclosed in the accepted quote or other written authorization.
13. Load Level / Overfill
All material must remain at or below the top rail and must be distributed so the dumpster can be transported safely and legally. An overfill fee starting at $150 applies to material loaded above the top rail or an otherwise overfilled container. Additional provider, handling, unloading, disposal, or return-trip charges may apply if material must be removed or repositioned, or if the dumpster cannot be transported safely or legally.
14. Dumpster Damage
Customer assumes responsibility for the dumpster while it is at the service location and agrees to pay for loss or damage caused by misuse, vandalism, unauthorized movement, fire, prohibited materials, or other acts or conditions within Customer's control, ordinary wear and tear excepted.
15. Broker / Service Provider Relationship
Bin Direct Rentals may arrange fulfillment through an independent dumpster provider, hauling company, or disposal facility. Customer authorizes Bin Direct Rentals to coordinate delivery, service, exchange, disposal, and pickup with the servicing provider. Provider and disposal charges can vary by location and transaction. The servicing provider may enforce reasonable site-access, safety, weight, prohibited-material, and service requirements applicable to the rental.
16. Entire Agreement and Electronic Acceptance
This Agreement, together with the accepted quote and any written addenda or approved changes, constitutes the agreement for the rental transaction. Electronic signatures and electronic records may be used to evidence acceptance to the extent permitted by applicable law.
17. Cancellations and Refunds
Customer may cancel at no charge before 5:00 PM Pacific time on the day before the scheduled delivery date, and any payment made will be refunded in full. If Customer cancels after that time, or a scheduled delivery cannot be completed for a reason described in Section 7, the return-trip fee stated in the accepted quote may be retained and the balance refunded. Refunds are made to the original payment method.
Customer Acknowledgment & Authorization
By signing below, Customer acknowledges that Customer has read, understands, and agrees to this Dumpster Rental Agreement and the accepted quote. Customer authorizes Bin Direct Rentals to invoice and collect applicable additional charges arising under this Agreement, including provider- or disposal-facility-assessed charges, subject to the agreed pricing and applicable law.
